Individual freedom took another hit todayas a result of a 5-4 decision of the U.S. supreme Court Monday declaring that an individual does NOT have the right to withhold his name from a peace officer. That it does NOT deny your Constitutional rights. Hmmm. Where in the U.S. Constitution is the government granted the right to pry information out of you at will? (See the Fourth Amendment). Hmmm (again). How could this even be a debatable issue IF the U.S. Constitution was fully intact, operational and protecting YOUR rights?
It doesn't seem so bad giving up your name to an officer BUT in today's age of massive personal information readily available at the click of a mouse, it would appear the tables are horribly tilted in the Government's favor and against the individual. Justice Kennedy for the majority said generally, disclosing an identity is "so insignificant in the scheme of things." For the Justices' to say "...what's in a name?" and "Obtaining a suspect's name in the course of a Terry stop serves important government interests," Kennedy wrote. Does that mean we're all suspects - even if there are no chareges agains us and we have done nothing wrong?
One concern I have is, where will this little "inconvenience" or intrusion stop? At what point will we be forced to have a national ID? When will it fall that we must submit to an iris or fingerprint check?
This IN FACT, is a huge loss for those of us who cherish individual privacy and freedom. And a huge win for the socialists, communists, authoritarians or whatever these people admit to being.
