Dear Representative Ellison,
It once again time to point out to Congress that the executive branch is out of control. The FDA is attempting to usurp your responsibilities by passing "rules" that seek to keep the American People from easily accessing appropriate and health benefit information about vitamins, minerals, food supplements and the like.
Their "Evidence-Based Review System for the Scientific Evaluation of Health Claims", Docket 2007D-0125, http://www.cfsan.fda.gov/~dms/hclmgui5.html is a violation of our rights under the First Amendment and under DSHEA, the 1994 Dietary Supplements Health and Education Act which says that supplements are foods and that consumers can have access to information about their benefits!
Representative Ellison, this is not merely freedom-robbing behavior by an executive agency but worse is usurpation of congressional responsibilities. We didn't elect the FDA, its officers or employees to anything! We did however, vote you in and as so, we fully expect that you will put a stop to this constant meddling by the FDA. Congressman Ron Paul authored a bill (HR 2117) The Health Freedom Protection Act which I strongly urge you to read and help him pass. It is absolutely vital to our continued individual freedom of choice and information concerning our health.
It is time for the House to remove the overarching FDA altogether if necessary. But certainly it is important for Congress to remove their ability to make our health lives difficult, costly and ambiguous without merit and beyond their authority to dictate or legislate!
